INTRODUCTION

These Terms and Conditions govern the interaction between you, the user, and us, Tapputi Egyptian Perfume Oils (Pty) Ltd, hereinafter referred to as “Tapputi”, when accessing or using the website www.tapputioils.co.za (the “Site”).

By using the informational and/or other services made available on the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy. Your continued use of the Site constitutes acceptance of these Terms and Conditions.

Tapputi reserves the right to amend, update or replace these Terms and Conditions at any time without prior notice. It is your responsibility to review these Terms and Conditions periodically for any changes.

BACKGROUND

Tapputi operates through the website www.tapputioils.co.za. The Site serves as an online platform through which users may access information about our products and services, purchase products, and, in future, access additional related services and facilities that may be introduced from time to time.

INFORMATION AND INTELLECTUAL PROPERTY POLICY

All publicly viewable information available on the Site is the sole intellectual property of Tapputi, unless otherwise stated.

Tapputi takes reasonable steps to ensure that the information made available on the Site is accurate, current and of an acceptable quality. However, Tapputi does not warrant that all information will always be complete, error-free or up to date.

ORDER POLICY

Tapputi’s employees, agents, logistics partners or designees will deliver orders placed on the Site once the order has been successfully placed and payment has been received and processed.

Pricing

All products offered for sale on the Site will be sold at the prices displayed at the time the order is placed, unless otherwise stated.

Cancellation Policy

To cancel an order and qualify for a full refund, you must contact us by telephone at 082 571 5772 or by email within 6 hours of placing the order.

If an order has already been dispatched, cancellation will not be possible unless the product is defective or unless otherwise required by law.

Your Warranties and Undertakings

You agree and confirm that:

  • in the event of non-delivery arising from incorrect information supplied by you, including but not limited to an incorrect name, address or contact details, any additional cost incurred by Tapputi for re-delivery may be charged to you;

  • you will use the services provided by the Site, its affiliates, consultants and contracted companies for lawful purposes only and in compliance with all applicable laws and regulations;

  • you will provide true, accurate and complete information wherever such information is requested;

  • Tapputi reserves the right to verify and validate the information provided by you at any time and, if such information is found to be false, inaccurate or misleading, Tapputi may, in its sole discretion, reject or cancel the order; and

  • prior to placing an order, you will review the product description and your order carefully, and by placing an order, you agree to be bound by the conditions of sale applicable to that product.

PRICING AND PROMOTIONS POLICY

Tapputi reserves the right, at any time and in its sole discretion, to amend, increase, decrease or otherwise adjust the prices of any products or services offered on the Site, and to amend, suspend, withdraw, extend or terminate any promotion, discount, voucher, bundle offer, special offer or campaign, with or without prior notice, to the fullest extent permitted by applicable law.

Any such change shall apply prospectively only and shall not affect any order that has already been confirmed by Tapputi and paid for by the customer, except where a price or promotion was displayed as a result of an obvious and inadvertent error, technical malfunction, system error, typographical error, or unauthorised alteration. In such circumstances, Tapputi reserves the right to cancel the affected order, refuse the order, or correct the pricing or promotional terms, provided that the customer is informed accordingly and, where payment has already been made, offered an appropriate refund or the option to proceed at the corrected price.

All promotions are subject to availability, the specific terms of the relevant offer, and any validity period stated on the Site or in promotional material. Where no validity period is stated, Tapputi reserves the right to withdraw or amend the promotion at any time, subject to applicable law.

VOUCHERS AND GIFT CARDS POLICY

Please note that vouchers may not be combined unless expressly stated otherwise.

Only one (1) voucher may be used per sale. Vouchers may not be stacked or used together on a single transaction unless specifically permitted by Tapputi.

Tapputi reserves the right to void, cancel, suspend or reject any voucher where necessary, including in cases of misuse, suspected fraud, technical error or breach of these Terms and Conditions.

Unless otherwise stated, all vouchers shall expire one (1) year, being 365 days, from the date of issue.

REVIEWS POLICY

Tapputi reserves the right to remove, moderate or refuse to publish any content, comments, reviews or feedback posted on its website or social media pages that includes, promotes or constitutes:

  • profanity;

  • harassment;

  • hate speech or abusive language;

  • defamatory statements;

  • false accusations of fraud, theft, criminal conduct or similar wrongdoing presented as fact;

  • incitement to damage property; or

  • any unlawful, threatening, discriminatory, harmful or offensive content.

Tapputi may remove such content at its sole discretion and without notice where it reasonably considers such content to be inappropriate, unlawful or harmful to its reputation, users or third parties.

COPYRIGHT AND TRADEMARK

Tapputi’s suppliers and licensors expressly reserve all intellectual property rights in all text, programs, products, processes, technology, content and other materials appearing on the Site.

Access to this Site does not confer, and shall not be considered as conferring, upon any person any licence under any of Tapputi’s or any third party’s intellectual property rights.

All rights, including copyright, in and to this website are owned by or licensed to Tapputi Egyptian Perfume Oils (Pty) Ltd. Any use of this website or its contents, including copying, storing, reproducing, distributing or publishing it in whole or in part, other than for your own personal, non-commercial use, is prohibited without the prior written permission of Tapputi.

You may not modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any content, information, software, products or services obtained from this Site.

“Tapputi”, together with all logos, names, graphics, button icons, page headers and other related branding, are service marks, trademarks and/or trade dress of Tapputi and may not be used by you except as expressly permitted in writing.

All other trademarks, service marks, product names and company names or logos appearing on the Site are the property of their respective owners.

References on this Site to any names, marks, products or services of third parties, or links to third-party websites or information, are provided solely as a convenience to you and do not in any way constitute or imply endorsement, sponsorship or recommendation by Tapputi of such third parties or their products or services.

Tapputi may employ third-party companies and individuals to perform certain functions, including but not limited to delivering packages, processing data and supporting business operations. Such third parties may have access to personal information only to the extent necessary to perform their functions on behalf of Tapputi.

DISCLAIMER OF WARRANTY AND LIMITATION OF LIABILITY

Your use of the Tapputi service and the Site is entirely at your own risk.

The Tapputi service and all content, materials, information, products and services made available through the Site are provided on an “as is” and “as available” basis, to the fullest extent permitted by law.

Tapputi disclaims all representations and warranties, whether express, implied or statutory, including but not limited to warranties relating to availability, accuracy, reliability, completeness, title, non-infringement, merchantability and fitness for a particular purpose.

Tapputi does not warrant that the functions contained on the Site will be uninterrupted or error-free, or that the Site, its servers or communications sent from Tapputi will be free of viruses or other harmful components.

Neither Tapputi nor any of its directors, employees, agents, licensors, contractors, service providers or associates shall be liable for any direct, indirect, incidental, special, consequential or punitive damages, or any loss of profit, revenue, data, goodwill or opportunity, arising out of or in connection with your use of, or inability to use, the Site, the services, the internet, or any products purchased through the Site, except where such liability cannot lawfully be excluded.

INDEMNITY

You agree to defend, indemnify and hold harmless Tapputi, its employees, directors, officers, agents, contractors, service providers, successors and assigns from and against any and all claims, liabilities, damages, losses, costs and expenses, including legal costs on an attorney-and-client scale where permitted by law, arising out of or related to:

  • your breach of these Terms and Conditions;

  • your misuse of the Site;

  • your violation of any law or regulation;

  • your infringement of any intellectual property or other rights of any third party; or

  • any act or omission by you which results in loss or liability to Tapputi or any third party.

This indemnity shall survive the termination or expiry of this User Agreement.
